Council Directive 92/106/CEE13 obliges companies specialised in the transport of goods and passengers, as well as in cabotage activities, non-bilateral transport operations or cross trade, to register their posted carrier in the new IMI portal. The IMI portal is a free, multilingual, and easy-to-use platform that the European Union has developed for the above-mentioned purpose.

In accordance with the provisions of EU Directive 2020/1057, as of February 2, 2022, the new mobility package came into force. The aim is to create a safe, efficient and socially responsible road transport sector, guaranteeing adequate working conditions and social protection for drivers as well as guaranteeing fair competition between road hauliers.

As a control measure, transport companies sending vehicles abroad must ensure that a Movement Declaration for the driver is issued to the relevant authorities in the Member State where the vehicle is travelling and this must be issued before the journey takes place. Vrio’s European Minimum Wage service ensures that you post all the documentation on time and in the correct format.

The Movement Declaration is a document certifying the activities carried out by drivers in the host territory of a Member State and covering a period from one day to a maximum of six months.

Drivers engaged in road freight transport who use vehicles weighing over 3.5 tons and road passenger transport using vehicles able to carry more than 9 people (including the driver).

Article 1, paragraph 2 of Directive (EU) 2020/1057 states that: “These specific rules shall apply to drivers employed by companies established in a member state.” It follows that only drivers who are employed are covered by this directive.

  • Cabotage: Understood as domestic transport operations for third parties, carried out temporarily in the territory of a Member State by an operator established in another Member State.
  • Non-bilateral transport operations or cross-trade: Understood as transport operations carried out between two Member States, or between a Member State and a third country, none of which is the country of establishment of the operator carrying out these operations.
  • International bilateral transport operations.
  • Limited additional loading and/or unloading activities.
  • Transit.
  • Initial or final leg of a combined transport operation.

A movement declaration can be made for a minimum period of one day and a maximum period of 6 months.

During a roadside check, the authority of the Member State where your driver is travelling may request the following documents:

  • A copy of the posting declaration submitted through IMI (electronic or paper format).
  • Proof of transport operations carried out in the host Member State, such as the electronic consignment note (e-CMR).
  • The data recorded by the tachograph and, in particular, the country symbols of the Member States in which the driver was present when carrying out international road transport or cabotage transport operations.
  • Work contract.
  • Payroll.
  • Proof of payroll payment.

Fines for non-compliance with the provisions contained in this regulation range between 135 and 1,500 euros, depending on whether the offense is considered minor or serious. A minor offense could be that, during a roadside inspection, the driver does not carry the movement declaration with them. On the other hand, it could be considered a serious infraction not to send, within the established period, the documentation that the Labor Authority of the Member State requests at any time.
